Instructions to the Executor
I. Upon notification to the authorities of the benefactor's quietus the named executor, Peter G. Costas, (see "Pertinent Addresses," page 11) shall then--having been provided with the official will and safety deposit key previously by the benefactor, James Boutos--at that time transfer will and deposit contents to: The Office of the President of the Cal State Hayward Educational Foundation (see "Pertinent Addresses," page 11). I.P. Restriction: if within one year of the executor's dispatch (revealing all assets, real and intellectual) University "trustees" of the last will's design have not published a minimum of one volume of the I.P. property (page 7), then beneficiaries (C.S.U.H.) shall concede all bequested property both real (page 8) and intellectual to the office of the President, U.N.L.V. Foundation, Gift Planning ("Pertinent Addresses," page 11).

Instructions to the Trustees

II. In either case, the aforementioned "trustees" shall be comprised of the President of the Educational Foundation, and the chair of the English department of the University, and its offices shall be responsible for informing the chancellor of the Universities and Colleges of the contribution of the benefactor toward the educational mission of the University. In the event of unforeseen contingencies, a para-legal "Academic For Negotiation" has been named (see Codicil, page 9).

III. During the first two years of bequeathed I.P. (see page 7) as a Restricted Gift, all funds generated (i.e., based on University and public sales of the literary legacy, world copyrights) shall establish an Endowment.

Fund (see page 5, article XIV) accounted for through the University Press or otherwise.

IV. Thereafter, a yearly 12% royalty shall be paid to my wife Aimilia Sevastou-Boutos ("Pertinent Addresses," page 11). In the event of a decree nisi, declared separation, or death the royalty shall be paid to the executor, Mr. Costas. The Academic Negotiator (see Codicil, page 10), should contingencies require his expertise, is then entitled to a percentage of copyright, or fee.

V. The remaining 88% (after impression and distribution costs) of the benefactor's I.P. estate shall be applied by the University for the purpose of establishing a writing program for destitute and homeless poets, regardless of age, sex, color, creed, religious or political beliefs.

VI. Room, board (outside the university) and public transportation shall be provided to a quota of Applicants (to be determined by the annual earnings of the literary works listed on Page 7).

VII. A no-credit creative writing program for poetry shall be superintended by the Chairperson of the English department, the University poet and professor in residence, and M.A. candidates who have qualified as T.A.'s (teaching assistants).

VIII. The Chairperson of the English department (being one of the named "trustees" of the Endowment Fund, E.H.P.) shall act as a liaison; the University's resident professor of poetry shall be responsible for the choice of T.A.'s who should be in the M.A. writing track degree program (Restricted Gift).

IX. The T.A.'s shall decide among those potential Applicants proof of commitment in the form of legible manuscripts of poetry submitted by the latter, and not less than 50 handwritten pages (see article XII, page 5).

X. As in VI of this document, T.A.'s salaries shall generate from the Endowment Fund at a rate per hour 10% above the norm.

XI. T.A.'s finally shall oversee a bi-annual campus chapbook consisting of poems written by those homeless "students" who have satisfied the writing program's minimum requirements for benefits.

XII. Minimum requirements for benefits will be determined by attendance of 3 day a week poetry workshops of 1 hour duration; these workshops may not be attended by registered University students since they are "no-credit" classes, nor may they be audited; minimum writing requirements for homeless "students" shall be set by T.A.'s (Restricted Gift).

XIII. Should an Applicant fail to meet the requirements of XII above within the first one month of workshops, he or she will be informed of their probationary status; should the Applicant fail in the following month to meet requirements of XII above then all benefits of VI, page 3, shall be suspended.

XIV. As the Endowment for the Homeless Poets (E.H.P.) is grounded on the principle of charity (with pedagogy providing an impetus for growth) the "trustees" of the endowment should accordingly apply for tax waivers whenever possible within the framework of the state in question (California/Nevada).

XV. Finally, in accordance with IX of page 4, Applicants may be required to present with their manuscripts, a proof of destitution or condition of homelessness guarantee from the H.E.W. of the University's home state (California/Nevada).

An open letter to the University President of Testamentary Gifts, C.S.U.H.:

I was honored as an early alumnus, over a quarter of a century ago, to be elected as a charter member of the newly founded Heritage Society of C.S.U.H. (see Nov. 27, 1996 letter, Director of Development, Susan M. Collins).

My assets foreseeably of specified amounts, a percentage of paternal estate, cash, securities, real property, appreciated personal property, life insurance policies, charitable remainder trusts, gift annuities plus pooled income funds...The depository also contains fine art...eight priceless rings, a rare Greek coin (the only one of its kind in the world). This depository is a non-restricted gift; intellectual property (page 2, article I, and page 7) is a restricted gift.

The willing of my literary legacy is largely humanitarian in the interests of the University and supporters of progress in education for the under-privileged in remembrance of the honorable, Horace Bushnell, founder of the University of California...

A post-will document, effecting the "whereabouts" of the depository, the benefactor will provide only to the executor for security reasons: Upon the demise of the benefactor, the executor shall forward the official will and "Finder's Document" to the aforementioned beneficiary. The executor's duties terminate thereafter.

Prudent perusal of this bequest by the beneficiaries shall reveal precedence of one University (California) over the other (Nevada). It is not the purpose of my last words to present my bequeathment as a contest of "winners" and "losers" between two of several distinguished Universities I have had the opportunity to attend in my lifetime, nor is it to be dismissed that solely materialistic values should be The Foundation's main consideration, but equal respect for revenues from intellectual designs and properties be weighed heavily: Thus, one depository is unrestricted, while the other is restricted. The latter, which for a quarter of a century confronted the former, I both now bequeath to the offices of the academy as a firm believer in education as the last remaining edifice of truly non-profit philanthropy. Therefore, as you will understand, the parameters of "assets suitable of bequeaths" cited in the aforementioned Testamentary Gifts (paragraph two of this open letter), I find lacking I.P. bequests, and hence, within the framework of the L.W.T. (page two, article I), an option to the University of Nevada is in order within the span of time (article I, page two). I draw your attention to this detail. Furthermore, in order to alleviate any possible misinterpretation for posthumous reasons, I believe fairness has been established in humanitarian intentions (page five, article XIV, line 2) regarding the...

Addendum 1: LITERARY LEGACY CONDITIONS
This addendum is an integral extension of the main body (Affidavit # 64: “Appointment of Chief Executor”) and has been authorized by the benefactor James George Boutos.
As benefactor, I hereby authorize the new Chief Executor Ryan A Gibbs entitlement to supercede all previous instruments (U.S. State Dept. Optional form #175 formerly FS-88, March 1975) in reference to C.S.U.E.B. if within 3 months after the benefactor’s demise, the Chief Executor, having delivered the financial and antiquities Ledgers (ref. “Finders Document” see codicil pg #8 U.S. State Dept. ) cannot negotiate publications with aforementioned University. In the event of default by aforesaid University, Chief Executor is bound by benefactor’s post demise instructions and U.S. State Department I.O.E. (pg. 9) to award new beneficiary U.N.L.V. with literary legacy and Ledgers. All files at that point will be transferred from C.S.U.E.B. to U.N.L.V. should the former default at the 3 month publishing parameter (post demise). Should this be the case, U.N.L.V. will be given a 3 year period in which to decide those volumes it deems publishable, without saying, ledgers (Finders Document becomes property of U.N.L.V.; any and all monies being rescinded from C.S.U.E.B. Ledgers). At any point, during negative negotiations between Mr. R.A. Gibbs and Former Universities, the Executor is entitled to withdraw the complete literary legacy, and financial antiquities ledgers (i.e. Finders Document). In the event of a private contract (non university affiliated) the Chief Executor shall have final say. Should a transfer of literary legacy and ledgers of financial and antiquities be ruled in order by Executor, Mr. R.A. Gibbs shall perform a full inventory of all manuscripts, objects of art, filmography, audio, and financial documents.

Addendum 2: PUBLISHING RIGHTS
This addendum is an integral extension of the main body (Affidavit # 64: “Appointment of Chief Executor”) and has been authorized by the benefactor James George Boutos.
The executor is entitled to full world translation publishing rights at a rate to be agreed upon between Mr. Ryan A. Gibbs and foreign publishers.

Addendum 3: MISSING AFFIDAVITS
This addendum is an integral extension of the main body (Affidavit # 64: “Appointment of Chief Executor”) and has been authorized by the benefactor James George Boutos.
In the event of a missing affidavit (U.S.A.) the benefactor warrants permissible the re-issue of the self same affidavit (text to be taken from internet postings of the merged Scott-Gibbs affidavit column) by those Notars (Principally Mrs. M.A. Finley of Sacramento, Mrs. Jan McPherson of Auburn and all others who sanctioned the originals). Addendum 4: HANDLING OF CORONERS REPORT

In the event of James G. Boutos demise, coroners report and autopsy information will be sent to Ryan A. Gibbs, 7233 Steiger Hill Rd. Vacaville, CA 95688. Ryan A. Gibbs is to post the coroners report on the Last will and Testament of James George Boutos (affidavit section; C.R. being last posted affidavit) upon the benefactor’s demise.


Addendum 5: FINDERS DOCUMENT

Recipients of 12% royalties (88% to University) imbursements for distribution (i.e. Chief Executor Ryan A. Gibbs is to act as the deceased benefactor’s accountant for royalties distribution) to the beneficiaries connected to the late James G. Boutos’ Literary works.

Addendum 7: CHIEF EXECUTORS POWER OF ATTORNEY
This addendum is an integral extension of the main body (Affidavit # 64: “Appointment of Chief Executor”) and has been authorized by the benefactor James George Boutos.
The Chief Executor, R.A. Gibbs, is entitled to collect funds from the Chase Bank, Woodland, California under the name of James G. Boutos (i.e. Monthly Social Security deposits to Chase Bank of Woodland, CA.) A.T.M. Only. The Chief Executor R.A. Gibbs is entitled to withdraw (A.T.M.) $500.00 every first of the new month, and $250.00 every second day of month.


Addendum 8: CHIEF EXECUTOR’S ENTITLEMENT IN THE EVENT OF DEFAULT (C.S.U.E.B.)
This addendum is an integral extension of the main body (Affidavit # 64: “Appointment of Chief Executor”):
Ryan Allen Gibbs, I as benefactor, James G. Boutos invest with authority to act in accordance with United States Department of State Optional form 175 (formerly FS-88 March 1975 Dept. of State) in reference to “Codicil” (Pg. 9; paragraph two; lines 6-16) in the event of default (C.S.U.E.B.) within the parameters legally stipulated (“Certificate of Acknowledgement of Execution of an Instrument,” form 175) and as follows authorize the Chief Executor’s powers in the event of default to:

1. After the demise of the benefactor present to the President (C.S.U.E.B.) “The Financial and Antiquities Ledgers” (in copy); should form 175 and its tenents not be adhered to (C.S.U.E.B.) within ninety days of the delivery of F&A Ledgers, the Chief Executor is then authorized by this Affidavit’s addendum #9 to declare a “State of Default” and accordingly, in confirmation with Codicil 9 (pg. 9), award U.N.L.V. as the recipient of the Literary, Financial, and Antiquities Legacy of James G. Boutos.
2. U.N.L.V. similarly must abide by the tenants of form 175 and all legal documents (affidavits, power of attorneys, etc.) pertaining to the Last Will and Testament with the three year parameter; Chief Executor, Gibbs, I as benefactor, instruct F & A ledgers (in copy) to be presented to the President of U.N.L.V. three months before the standard time parameter (three years) expires. Similarly should U.N.L.V. not conform to form 175 and all pertinent documentation, I invest all power to Chief Executor Ryan A. Gibbs to declare a State of Default. In the event of a State of Default, all financial and antiquities contributors are rescinded and must be returned to the Chief Executor Ryan A. Gibbs, 7233 Steiger Hill Rd. Vacaville, CA 95688, email gibbssac@aol.com and judithbornstein@gmx.com
3. In the event of private publication, full authority is delegated to the Chief Executor: note— no M.M.S. shall be released before Chief Executor’s duties of copyrighting or Writer’s Guild registrations. Ryan A. Gibbs in this last case, I invest full authority to negotiate royalty terms. Ryan A. Gibbs as Chief Executor should default occur, in any case, shall be responsible for “inventory checks” before transference from one University to another; the Chief Executor in the private sector shall always demand a bond ($25,000) to be held in equity until the volume he has released is returned, or a “Letter of Intention to Publish” is presented (notarized) to the Chief Executor.

All Encompassing Power: Ryan A. Gibbs as Chief Executor of the Estate— The Last Will And Testament of James G. Boutos— shall have final say in the academic sector and in the private sector as circumstance dictates. In the latter sector, publishers of Zionist backgrounds are excluded.

ADDENDUM 9: AFFIDAVIT MAINTENANCE
This addendum is an integral extension of the main body (Affidavit # 64: “Appointment of Chief Executor”) and has been authorized by the benefactor James George Boutos.
The Chief Executor is responsible for the maintenance, listed on all Affidavits of the Gibbs Merger (See James C. Scott) insofar as the e-mail address of “Judith Bornstein.” The benefactor shall be informed of all communications directed to judithbornstein@gmx.com by R.A. Gibbs, Chief Executor.

Addendum 10: IN THE EVENT OF THE DEMISE OF A BENEFICIARY

This addendum is an integral extension of the main body (Affidavit # 64: “Appointment of Chief Executor”) and has been authorized by the benefactor James George Boutos.
Royalty default of a beneficiary shall result when it is found by the Chief Executor Ryan A. Gibbs that:

1. The Beneficiary’s demise determines default.
2. Or, the whereabouts of the beneficiary after sufficient search (www) by two professional search groups nets no beneficiary. In the event of number 1 or 2 above, executor shall be entitled to that percentage of the defaulted beneficiary.

Addendum 11: SECOND EDITION, AND CONSECUTIVE EDITIONS CLAUSES

This addendum is an integral extension of the main body (Affidavit # 64: “Appointment of Chief Executor”) and has been authorized by the benefactor James George Boutos.
Chief Executor Gibbs’ Royalty distribution to beneficiaries increases from .05% to 1% (2nd edition) to 1.5% (3rd edition) to 2% (4th edition and consecutive editions) for all 39 volumes (to date, 2010).

Addendum 14: PERCENTAGE TO GONZALVES FAMILY

Per $100,000 of profit Chief Executor Ryan A. Gibbs intakes, 5% is to go to the Gonzalves Family, 24872 Muir St. Hayward, CA 94544. This addendum is not applicable to Gibbs’ only royalties (i.e. The Pharaohess & The King of Hearts,) beneficiaries’ demise, or untraceable whereabouts.

Addendum 15: HOLD OUT VOLUMES/CHIEF EXECUTOR’S ROYALTIES.

This addendum is an integral extension of the main body (Affidavit # 64: “Appointment of Chief Executor”) and has been authorized by the benefactor James George Boutos.
Chief Executor Ryan A. Gibbs is authorized to publish the following works in the following specific timeframes.

1. The American Tragedy: If not previously published by the benefactor, Chief Executor R.A. Gibbs is authorized to publish this work 5 years after the death of the benefactor, and is entitled to 12-14% of the royalties involved.

Addendum 16: HARVARD SCROLL (PART I: THE RECLUSE)

This addendum is an integral extension of the main body (Affidavit # 64: “Appointment of Chief Executor”) and has been authorized by the benefactor James George Boutos.
Chief Executor shall hold intellectual archival property rights to original scroll; in addition to originals and prints of James G. Boutos’ paintings (6% originals; 100% prints, i.e. “Britney Spears Collection” a.k.a. Peter Pericles Pootsos). These profit percentages would be allocated to the Chief Executor, Ryan A. The Chief Executor, R.A.Gibbs, is entitled to an open periodical check of inventory whenever R.A. Gibbs deems so.

Addendum 18: CHIEF EXECUTOR’S ENTITLEMENT TO SUE FOR INTELLECTUAL PROPERTY INFRINGEMENT

Large print for the elderly should be considered. All graphic and font and binding decisions (hardback and paperback) are the Chief Executor’s decision.
